1.0 Introduction
These Terms and Conditions ("Agreement") govern the use of travel-related services provided by Acorn Travels; a limited liability company incorporated in Sri Lanka. By booking services with us or accessing our website, you agree to be legally bound by these terms, applicable Sri Lankan laws, and any additional supplier conditions. This Agreement applies whether you make a booking directly with us or through our online platform.
2.0 Definitions
"Company" refers to Acorn Travels.
"Client" or "You" refers to any individual or entity using our services.
"Supplier" means third-party providers including airlines, hotels, cruise operators, ground transport, insurance providers, etc.
"Force Majeure" refers to events beyond the reasonable control of the Company, including but not limited to:
3.0 Booking and Confirmation
3.1 A booking is confirmed once full payment is received and a confirmation receipt is issued.
3.2 Clients must ensure that the name provided at the time of booking exactly matches the name on their official ID or passport. Discrepancies may lead to denied boarding or additional amendment charges by the airline.
3.3 Travel documents including tickets, itineraries, and hotel vouchers will be sent to the client’s email address. unless otherwise asked by the client
3.4 Clients must notify the Company within 48 hours if travel documents are not received.
3.5 The Company reserves the right to decline or cancel any booking for any reason, including suspected fraud.
4.0 Payments and Pricing
4.1 All prices are subject to change without prior notice due to airline pricing and seat availability and are not guaranteed by the company until full payment has been made. The company shall not be held liable for any price variations resulting from such changes.
4.1. 1 All quotations provided are valid only on the date of issuance and are subject to change thereafter without prior notice. Such changes may occur due to factors beyond the Company’s control, including but not limited to airline fare adjustments, seat availability, and currency fluctuations. The Company shall not be held liable or responsible for any variations in pricing arising from such changes, as these are determined by third parties, including airlines.
4.1.2 Prices are subject to change based on airline class availability at the time of booking confirmation.
4.2 Payment methods accepted include cash payments, Visa, MasterCard, cheques and bank transfers.
4.3 The Company reserves the right to add surcharges due to changes in fuel prices, tax increases, or currency fluctuations.
4.4 All prices quoted include service charges, unless otherwise stated.
5.0 Amendments and Cancellations
5.1 Clients may request changes to bookings subject to availability and supplier policies.
5.2 Amendment Charges
Any fees applicable for amendments shall be determined in accordance with the relevant airlines or supplier’s policies, fare rules and terms and conditions. Such fees may vary depending on the nature and timing of the amendment, and may include additional fare differences, service charges, or penalties imposed by the airline or supplier. All amendment requests are subject to availability and acceptance by the airline or supplier, and the Company shall not be held liable for any refusal or additional costs arising therefrom.
5.2.1 Once an e-ticket is issued, any changes or amendments may incur additional penalties as determined by the respective airline or service provider.
5.3 Cancellation charges:
Any charges applicable for cancellations shall be determined in accordance with the relevant airlines or supplier’s policies, fare rules and terms and conditions. Such charges may vary depending on the timing of the cancellation and may include, but are not limited to, non-refundable portions of the fare, penalties, service fees, or other costs imposed by the airline or supplier. All cancellation requests are subject to the applicable airlines or supplier’s acceptance, and the Company shall not be held liable for any refusal, additional costs, or loss of funds resulting from such cancellations.
5.4 Refunds will only be processed once original documents are returned and refunds are received from the Supplier.
6.0 Special Requests and Travel Requirements
6.1 The Company will forward any special requests made by the client (e.g., dietary needs, accessible rooms), but cannot guarantee fulfillment.
6.2 Clients traveling with children must provide accurate date of birth details and ensure child age requirements are met.
6.3 Clients booking car rentals must produce a valid international driving license and declare any driving convictions.
7.0 Passports, Visas, and Health Requirements
7.1 Clients are responsible for ensuring all passport, visa, and health requirements are met for each destination prior to departure.
7.2 Clients must ensure their passport is valid for a minimum of six months beyond the intended date of return.
7.2.1 Passports must contain at least two blank pages to accommodate visa stamps and border control requirements.
7.3 The Company acts only as a facilitator for visa processing and is not responsible for embassy decisions.
7.4 Vaccinations may be required for specific destinations. Clients must consult relevant health authorities.
8.0 Travel Insurance
8.1 Comprehensive travel insurance covering cancellation, medical, baggage, and personal liability is mandatory for some services.
8.2 Insurance must be purchased before travel commences.
9.0 Limitations of Liability
9.1 The Company is not liable for any act, error, omission, or default of suppliers.
9.2 Any disputes must be addressed directly with the Supplier.
9.3 The Company is not liable for loss, injury, or damage to person or property during travel.
9.4 Liability is limited to the amount paid by the client for the services in question.
10.0 Website Use and Intellectual Property
10.1 All website content (text, images, software, trademarks) is the property of the Company or its licensors.
10.2 Unauthorized use, reproduction, or distribution of website content is prohibited.
10.3 Clients agree not to upload viruses, malware, or perform any actions that compromise the security or functionality of the website and if done so, will be met with severe legal action.
11.0 Data Protection and Privacy
11.1 The Company complies with the Personal Data Protection Act No. 9 of 2022 (Sri Lanka).
11.2 Personal data is collected only for service fulfillment and internal business purposes.
11.3 Clients consent to the transfer of data to third parties for booking and service delivery.
11.4 The Company is not responsible for the privacy practices of linked third-party sites.
12.0 Complaints and Dispute Resolution
12.1 Complaints must be reported to the company within 24 hours and to the supplier in writing within 7 days.
12.2 The Company will endeavor to resolve complaints amicably.
12.3 If unresolved within 30 days by the parties, disputes will be referred to arbitration in Sri Lanka under UNCITRAL rules.
13.0 Force Majeure
13.1 The Company shall not be held liable for any delay or failure in performance of its obligations under this Agreement if such delay or failure is due to Force Majeure events as defined in section 2.0.
13.2 No compensation or refund shall be payable for services not rendered or partially rendered due to such events.
13.3 The Company will, where possible, assist clients in making alternative arrangements at their own cost.
14.0 Governing Law and Jurisdiction
14.1 These terms and conditions are governed by the laws of the Democratic Socialist Republic of Sri Lanka.
14.2 All disputes shall be subject to the exclusive jurisdiction of Sri Lankan courts or arbitration where applicable.
15.0 Miscellaneous
15.1 The Company reserves the right to revise these Terms without prior notice. Updates are effective once posted online.
15.2 Invalidity of any clause shall not affect the validity of the remaining terms.
15.3 Use of services constitutes acceptance of all applicable terms, including the Privacy Policy.
